This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.
We use Your Personal data to provide the assistance services rendered through the Application. By using the Application, You agree to the collection and use of information in accordance with this Privacy Policy. One important point to notice: Your Personal Data are accessible to our team only when you press the “Emergency button” of the Application. Apart from that, we’ll never have access to your data, which are end to end encrypted

Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Application or parts of our Application.
- Application refers to the Medical Assistance App powered by Newlogic, that allows You to reach our medical assistance teams in case of emergency or in case of assistance is needed.
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Aware Assistance, Unit B&C, 20/F Full Win Commercial Centre, 573 Nathan road, Yaumatei Kowloon, Hong Kong.
- Cookies are small files that are placed on Your mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
- Country refers to: the country where the App is used at the moment when the service is rendered (see in the settings)
- Device means any device that can access the Service such as a cellphone or a digital tablet.
- Personal Data is any information that relates to an identified or identifiable individual.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

- You means the individual accessing or using the Application, or the company, or other legal entity on behalf of which such individual is accessing or using the Application, as applicable.

Types of Data Collected
Personal Data to be shared with medical team in case of emergency
In order to be able to provide you with the best medical assistance service, we ask you to share with us some of your Personal Data in Our Application. We ask You to provide Us with personally identifiable information, some that we’ll use to contact and identify You, some that might be shared with your treating medical doctor should you be hospitalized (like Your blood group, allergies, current medication...). These Data won’t be shared with your insurance, unless you allow us to do so. Also, We can only have access to these Data after you press the Application Emergency button. Personally identifiable information include, but is not limited to:
- Email address
- Passport picture (to speed up paperwork procedure for border crossing in case of emergency)
- Phone & preferred messenger application app contact details
- Emergency contact details
- Personal & family medical history (blood group, allergies...)
Usage Data
Our Application is only collecting Usage data related to the Application’s potential errors & bugs.
Tracking Technologies and Cookies
Our Application do not use Cookies nor similar tracking technologies.
Use of Your Personal Data
The Company can use Personal Data for the following purposes and only when You press the emergency button of the Application:
- To access to the medical information you decided to share with us: Our local call center immediately receives a link to access to your personal medical information
- To localize you using your GPS coordinates: To being able to send you an ambulance or a rescue team.
- To manage Your Account: To manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Application that are available to You as a registered user.
- To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication in case of emergency. Also to contact you via mobile application's push notifications regarding updates or informative communications related to the functionalities, including the security updates, when necessary or reasonable for their implementation.
- To provide You with news and general information about healthcare or safety issues that may arise depending on the country that you’re staying at, at the moment of the notification.
- To manage Your requests: To attend and manage Your requests to Us.
We will only share Your personal information in case of emergency in the following situations:
- With Service Providers: We may share Your personal information with Service Providers such as emergency ambulance services, receiving hospital & duty doctor in case you’re transferred urgently to a healthcare facility that needs to access to your medical information.
We will not share Your personal information with:
- Your insurance company or any other third party: Your personal medical information that you share with Us when pressing the “Emergency” button will not be shared with anyone outside of the medical teams that will take care of you (being the ambulance crew or the doctor in charge in the receiving hospital). We’ll only share with your insurance the information you’ll allow us to share: Medical report & screenings needed for confirmation of coverage, medical expenses...
Retention of Your Personal Data
The Company will retain Your Personal Data as long as you’ll keep them stored in your phone.
Storage of Your Personal Data
In Your phone:
- Basic User information (email, name, country, etc.)
- Personal Information (passport, medical record, contact info, etc.)
- Family password (for encryption of Your personal information)
Note: (data are temporarily stored until user logouts from device)
In the AWS Server
- User credentials (username/password)
In the Zoho CRM Server
- Basic User information, Encrypted Personal Information & Encrypted Family password
Disclosure of Your Personal Data
Law enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
Other legal requirements
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
- Comply with a legal obligation
- Protect and defend the rights or property of the Company
- Prevent or investigate possible wrongdoing in connection with the Service

The security of Your Personal Data is important to Us. Your Data and Your passwords are end to end encrypted to ensure maximum security.

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.
We will let You know via email and/or a prominent notice on Our Application, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.
